Thank you for your interest in my work. These terms are here to protect the time, care, and creative process behind each piece, whether you are purchasing original artwork, prints, hand-painted pieces, licensing a pattern, or inquiring about a custom project. By placing an order, paying an invoice, or entering into a project with Niki Weinberg, you agree to the terms below.

Artwork, Prints & Products

Niki Weinberg offers original artwork, fine art prints, hand-painted pieces, surface pattern designs, placement artwork, and other artist-made or artist-designed goods. Each piece is created with care and may include subtle variations due to the nature of hand-painted artwork, printing methods, materials, screen display differences, and production processes.

Colors may appear slightly different in person than they do on screen. Every effort is made to represent artwork accurately, but exact color matching cannot be guaranteed.

Original Artwork & Hand-Painted Pieces

All original artwork and hand-painted pieces are sold as unique or limited works. Slight variations, brushwork, texture, and handmade details are part of the character of the piece and are not considered flaws.

All sales of original artwork and hand-painted pieces are final unless otherwise stated in writing.

Prints & Reproductions

Prints and reproductions are created from original artwork by Niki Weinberg. Print sizes, paper types, materials, and production details will be described in the product listing when applicable.

Because prints may be produced in small batches or made to order, returns and exchanges are not accepted unless the item arrives damaged or there is a clear fulfillment error.

Licensing & Surface Pattern Design

All artwork, illustrations, surface patterns, placement designs, and related creative work remain the intellectual property of Niki Weinberg unless rights are specifically transferred in a signed written agreement.

Licensing terms, usage rights, exclusivity, territory, product categories, royalties, fees, duration, and renewal terms must be agreed upon in writing before any artwork may be used commercially.

No artwork, pattern, illustration, sketch, mockup, or design may be copied, manufactured, reproduced, distributed, altered, resold, used for AI training, or used on products without written permission or a formal licensing agreement.

A purchase of artwork, prints, or products does not include copyright ownership or commercial reproduction rights.

Custom Work & Commissions

Custom projects, placement pieces, commissioned artwork, hand-painted goods, and special requests may be accepted at the discretion of Niki Weinberg.

Because custom work is created specifically for the client, all sales are final once work has begun. Deposits, retainers, and payments for custom work are non-refundable unless otherwise agreed upon in writing.

Custom work will be created in the artistic style of Niki Weinberg. While client ideas, references, and preferences may be considered, exact replication of another artist’s work, existing copyrighted artwork, logos, fonts, or protected designs will not be accepted.

Proofs, Revisions & Approvals

For custom projects or design work, proofs may be provided as outlined in the proposal, invoice, or written agreement.

It is the client’s responsibility to carefully review all proofs, mockups, layouts, spelling, dates, names, colors, measurements, and details before approval. Once a proof is approved, Niki Weinberg is not responsible for errors that were present in the approved version.

Any revisions beyond the agreed scope may require an additional fee.

Project Scope

Each custom project, licensing project, or collaborative project will be based on the agreed scope of work. Requests outside the original scope may require an adjusted timeline, additional fees, or a separate agreement.

Niki Weinberg reserves the right to decline work that is not aligned with the studio’s artistic direction, schedule, values, or current availability.

Cancellations & Refunds

For custom work, cancellations are not available once design, sketching, painting, research, sourcing, or production has begun.

If a cancellation request is made before any work has started, Niki Weinberg may, at her discretion, refund a portion of the payment less administrative fees, transaction fees, and any time already spent on communication, planning, or preparation.

For ready-made artwork, prints, and products, cancellations may only be possible before the item has shipped or entered production.

Returns & Exchanges

All sales are final on original artwork, custom work, commissioned pieces, hand-painted items, and made-to-order goods.

Returns and exchanges are not accepted unless an item arrives damaged or there has been an error in fulfillment. If your order arrives damaged, please contact Niki Weinberg within 48 hours of delivery with photos of the item, packaging, and shipping label so the issue can be reviewed.

Shipping & Delivery

Shipping costs, timelines, and delivery methods will vary depending on the item, destination, and carrier.

Niki Weinberg is not responsible for shipping delays, lost packages, stolen packages, customs delays, or damages caused by the carrier once an order has shipped. Clients and customers are encouraged to select tracked and insured shipping when available.

Shipping transit times are estimates only and are not guaranteed.

Timelines

Project timelines for custom work, licensing preparation, artwork delivery, or production will be outlined in the proposal, invoice, or written agreement when applicable.

Timelines may be affected by client response time, revision requests, material availability, production schedules, licensing negotiations, printer/vendor delays, shipping issues, or circumstances outside the studio’s control.

Client-Supplied Materials

If a client provides reference images, logos, text, photographs, heirlooms, family materials, or other content for a project, the client confirms that they have the right to use those materials.

Niki Weinberg is not responsible for copyright, trademark, privacy, or permissions issues related to materials supplied by the client.

Copyright & Intellectual Property

All artwork, sketches, paintings, illustrations, patterns, layouts, photographs, product images, website content, text, designs, mockups, and creative concepts remain the property of Niki Weinberg unless otherwise stated in a signed written agreement.

Purchasing an original piece of art gives the buyer ownership of the physical artwork only. It does not transfer copyright, reproduction rights, licensing rights, or the right to create derivative works.

Artwork may not be scanned, copied, altered, reproduced, resold, manufactured, distributed, minted as an NFT, used with artificial intelligence tools, or used commercially without written permission.

Use of Images & Portfolio Rights

Niki Weinberg reserves the right to photograph, scan, film, share, and display completed artwork, custom work, licensed designs, mockups, process images, and final pieces for portfolio, marketing, social media, educational, promotional, and website purposes.

If a project is confidential or requires delayed sharing, this must be agreed upon in writing before the project begins.

Licensing Confidentiality

For licensing clients, confidential terms such as rates, royalties, exclusivity, product categories, contracts, launch dates, and private business details will not be shared publicly unless both parties agree in writing.

Niki Weinberg may share artwork, mockups, product images, or licensed collaborations for portfolio and promotional purposes unless restricted by the licensing agreement.

Artistic Integrity

By purchasing, licensing, or commissioning work from Niki Weinberg, you acknowledge that the work will reflect her artistic style, process, and creative judgment.

Custom work and licensed artwork are not intended to be exact copies of outside references, trend images, Pinterest boards, competitor products, or another artist’s style.

Niki Weinberg reserves the right to make artistic decisions regarding composition, color, scale, detail, materials, and final presentation.

Third-Party Vendors & Production Partners

Some products, prints, reproductions, textiles, wallpaper, or merchandise may be produced through trusted third-party printers, manufacturers, fulfillment partners, or vendors.

While every effort is made to work with quality production partners, Niki Weinberg is not responsible for vendor delays, material shortages, slight production variations, or carrier-related issues outside the studio’s control.

Website Content

All content on this website, including artwork, images, designs, copy, logos, product descriptions, and branding, is owned by Niki Weinberg unless otherwise credited.

You may not copy, reproduce, download, alter, distribute, or use any website content for personal, commercial, educational, AI training, or promotional purposes without written permission.

Payment

Payment terms will be listed in the product listing, invoice, proposal, or written agreement.

For custom work, commissioned work, licensing preparation, or special projects, work may not begin until the required deposit, retainer, or payment has been received.

Payment of an invoice, deposit, retainer, or licensing fee indicates agreement to these terms and conditions.

Agreement

By placing an order, purchasing artwork, commissioning a piece, licensing artwork, approving a proof, or paying an invoice, you confirm that you have read and agree to these terms and conditions.

Niki Weinberg reserves the right to update these terms at any time. The terms in place at the time of purchase, project booking, or agreement will apply unless otherwise stated in writing.
